Refund & Cancellation Policy
Effective Date: January 15, 2025
This Refund & Cancellation Policy ("Policy") constitutes a legally binding agreement between you ("User," "you," or "your") and Nowah Labs, Inc. ("Nowah," "we," "us," or "our"). By using the Nowah application or services, you acknowledge that you have read, understood, and agree to be bound by this Policy in its entirety. This Policy is incorporated by reference into our Terms of Service.
1. Subscription Services — Platform-Managed Billing
All Nowah subscription services ("Subscription Services") are offered exclusively through the Apple App Store and Google Play Store (collectively, "Platform Providers"). Nowah does not directly process, manage, or control subscription payments, billing, or refunds.
By purchasing a subscription through a Platform Provider, you enter into a separate billing agreement governed by that Platform Provider's terms of service and refund policies. Nowah is not a party to this billing relationship and has no authority to issue, approve, deny, or process refunds for subscription charges.
To request a subscription refund, contact your Platform Provider directly:
Refund eligibility, processing times, and outcomes are determined solely by the applicable Platform Provider in accordance with their policies. Nowah expressly disclaims any responsibility or liability for refund decisions made by Platform Providers.
2. Travel Bookings — Third-Party Provider Policies
Nowah acts solely as an intermediary platform that facilitates connections between users and third-party travel service providers, including but not limited to airlines, hotels, car rental companies, and activity operators (collectively, "Travel Providers"). Nowah is not the merchant of record, ticket issuer, or service provider for any travel booking.
All travel bookings are subject to the terms, conditions, fare rules, and refund policies of the applicable Travel Provider. These policies vary by provider, fare class, rate type, and booking conditions. Nowah has no authority to override, modify, or circumvent Travel Provider refund policies.
- Flights: Governed by the issuing airline's fare rules, Contract of Carriage, and applicable aviation regulations
- Hotels: Subject to the property's cancellation policy as displayed at time of booking
- Other Services: Governed by the respective provider's terms and conditions
To request a refund or cancellation for travel bookings, you must contact the Travel Provider directly or submit a request through the Nowah app, which we will forward to the applicable provider. Final refund decisions rest exclusively with the Travel Provider.
3. Nowah Credit & Promotional Balances
Nowah Credit, rewards, promotional balances, referral bonuses, and any other non-cash value stored within your Nowah account (collectively, "Credits") are:
- Non-refundable under any circumstances
- Non-transferable to other users or accounts
- Non-redeemable for cash, check, or cash equivalent
- Subject to expiration as specified in the applicable promotional terms
- Forfeited upon account termination, whether voluntary or involuntary
Credits have no monetary value and do not constitute property of the User. Nowah reserves the right to modify, suspend, or terminate Credit programs at any time without prior notice or liability.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOWAH SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:
- Refund requests denied by Platform Providers or Travel Providers
- Delays in refund processing by any third party
- Travel disruptions, cancellations, or modifications by Travel Providers
- Loss of Credits due to account termination or program changes
- Any acts, omissions, or policies of third-party service providers
In no event shall Nowah's total cumulative liability exceed the lesser of (a) the amounts paid by you to Nowah in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
5. Dispute Resolution & Governing Law
This Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to this Policy shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
For disputes involving amounts less than $10,000 USD, arbitration shall be conducted remotely via telephone, video conference, or written submissions. The arbitrator's decision shall be final and binding.
6. Severability & Entire Agreement
If any provision of this Policy is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from this Policy. The remaining provisions shall continue in full force and effect.
This Policy, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Nowah regarding refunds and cancellations, and supersedes all prior or contemporaneous communications, representations, or agreements.
7. Modifications to This Policy
Nowah reserves the right to modify this Policy at any time at its sole discretion. Material changes will be communicated through the app or via email. Your continued use of Nowah services following any modifications constitutes acceptance of the revised Policy.
