Terms of Service

To use the Services, you must:

• Be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Services under applicable law
• Not be located in, or a resident of, any jurisdiction subject to comprehensive U.S. sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine)

By using the Services, you represent and warrant that you meet all eligibility requirements. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept full responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

Nowah is not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

Nowah is an AI travel agent. Through chat and voice, you can:

• Search, compare and book flights and hotels
• Buy travel eSIMs
• Plan itineraries, including from videos and links you share
• Check visa and entry information
• Track fares and get price alerts, and use travel tools such as currency, tipping, translation and bill splitting

AI can make mistakes. Answers, itineraries, prices, visa and entry information and place details are generated by AI models using third-party data and can be incomplete, out of date or wrong. Check anything important, especially visa, passport, health and entry requirements, with the airline, embassy or official government source before you travel. You are responsible for having the right documents for your trip.

Nothing is booked without you. Nowah shows you the itinerary, traveller details and total price before any booking or charge, and books only after you confirm. Check the names, dates and passport details before confirming; they must match your travel documents.

Your chats, voice and files are processed by third-party AI providers as described in our Privacy Policy.

Nowah Pro is an optional paid membership, sold monthly or yearly. The purchase screen shows what it includes, the price, the billing period and any introductory offer.

• In the iOS app, Nowah Pro is billed by Apple (or Google on Android). On nowah.xyz it is billed by Nowah through our web payment provider.
• It renews automatically at the end of each period unless you cancel at least 24 hours before. Cancel in your Apple ID subscription settings, Google Play, or your Nowah account for web purchases. Cancelling stops future renewals; you keep Pro until the end of the period you paid for.
• An introductory price (for example a lower first year) applies once per subscriber, for the stated period. After that, the plan renews at the regular price shown at purchase.
• Price changes follow Apple's or Google's notice and consent rules, and for web purchases we tell you in advance. Where your consent is needed, the increase won't apply without it.
• Fair use. "No message limit" means no cap for normal personal use. To keep the service fast and fair, we may slow or route very heavy use to lighter models. Live voice has daily and weekly time limits, which the app shows when you reach them.
• Yearly eSIM benefit. Free eSIMs on the yearly plan are earned on eligible international flight bookings made with Nowah, one per booking, up to the number stated at purchase each membership year. Unlimited-data eSIM plans are excluded.
• Benefits may change over time. We won't materially reduce what you paid for during a period you've already paid for.

Your use of the iOS app is licensed under the Apple Standard End User License Agreement (EULA). If these Terms conflict with the Apple EULA on app licensing or Apple's rights, the Apple EULA controls. For refunds, see our Refund Policy.

Nowah books flights, hotels and eSIMs through suppliers such as MystiFly, Hotelbeds and Airalo, which in turn book with airlines, hotels and mobile networks ("Travel Providers").

• Payment. Nowah charges your card through Stripe for the total shown at checkout and pays the supplier. The total includes taxes and supplier charges.
• Service fee. Flight bookings include a Nowah service fee of 5% of the fare. Hotel bookings may include a Nowah service fee. Any fee is shown in the total before you confirm; there are no hidden add-ons.
• Your contract for the trip is with the Travel Provider, under its fare rules, conditions of carriage and policies. Baggage, seats, changes, cancellations and refunds follow those rules, which Nowah shows where available before you book.
• If a booking can't be completed after you pay, for example because the fare is no longer available or the ticket can't be issued, we refund you in full.
• eSIMs are supplied by Airalo on local mobile networks. Check that your phone is unlocked and supports eSIM before buying. Data, validity and coverage are as shown at purchase.
• Prices change until you pay. If a supplier changes the price before booking, we ask you again before charging.

Nowah is responsible for its own service, including taking your payment and passing your booking correctly to the supplier. Nowah is not responsible for what Travel Providers do or fail to do, including cancellations, delays, overbooking, schedule changes, lost baggage, network coverage or the quality of accommodation. Your rights against an airline, for example under passenger rights laws, are not affected.

On the free plan, each chat turn uses one message. You get free messages when you sign up and can earn more through quests and bookings, up to the limits shown in the app. Messages, quest awards and other rewards:

• Have no cash value, can't be bought, sold or transferred, and aren't refundable
• Are removed if your account is closed
• May be withdrawn if earned through abuse, fraud or a refunded booking

We may change how many messages you get or how quests work, and will show the current rules in the app.

You agree not to:

• Violate any applicable law, regulation, or third-party rights
• Provide false, misleading, or fraudulent information
• Use the Services for any unlawful purpose, including fraud, money laundering, or terrorist financing
• Attempt to circumvent security measures, access unauthorized systems, or interfere with Service operation
• Use automated scripts, bots, scrapers, or data mining tools without express written permission
• Reverse engineer, decompile, or disassemble any aspect of the Services
• Resell, redistribute, or commercially exploit the Services without authorization
• Harass, threaten, or defame other users or Nowah personnel
• Upload malicious code, viruses, or other harmful material
• Engage in any activity that could damage, disable, or impair the Services

Violation of this Section may result in account suspension or termination, removal of messages and rewards, and referral to law enforcement authorities.

You may give Nowah content such as messages, voice, photos, documents, links and trip plans ("User Content"). By doing so, you:

• Grant Nowah a worldwide, royalty-free licence to host, process and use it to provide, secure and improve the Services, and to share it with the providers described in our Privacy Policy for those purposes
• Grant a further licence to display content you choose to make public, such as a shared trip, for as long as it stays shared
• Represent that you own or have rights to the content and that it does not infringe third-party rights
• Acknowledge that Nowah has no obligation to monitor, review, or remove User Content
• Agree that Nowah may remove content that violates these Terms at its sole discretion

You keep ownership of your User Content. We don't publish your private chats, voice, photos or documents. The licence ends when you delete the content or your account, except for copies we must keep by law or that are already in backups.

The Services and all content, features, and functionality (including but not limited to software, code, text, graphics, logos, trademarks, images, audio, video, and the design, selection, and arrangement thereof) are owned by Nowah, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Nowah," the Nowah logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nowah Inc. You may not use such marks without our prior written permission.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the Services.

Your use of the Services is subject to our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Services, you consent to our collection, use, and disclosure of your information as described in those policies.

You agree to indemnify, defend, and hold harmless Nowah, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Services
• Your User Content
• Your violation of any law or rights of a third party
• Any dispute between you and a Travel Provider
• Any claim that your actions caused damage to a third party

Nowah reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination does not entitle you to a refund of any subscription fees.

Termination by Nowah: We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended inactivity
• Request by law enforcement or government agency
• Discontinuation of the Services

Effect of Termination: Upon termination, your right to use the Services ends and any messages or rewards are removed. Bookings you already paid for stay with the Travel Provider. Sections 8-13 and 15-20 survive termination.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

You agree that any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts.

Nowah shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, pandemics, epidemics, government orders, labor disputes, internet or telecommunications failures, cyberattacks, or power outages.

Nowah reserves the right to modify these Terms at any time at its sole discretion. Changes will be effective upon posting to this page with an updated "Effective Date." We may, but are not obligated to, provide notice of material changes via email or in-app notification.

Your continued use of the Services after any modifications constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Services. It is your responsibility to review these Terms periodically.

Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Nowah regarding the Services and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed. The remaining provisions shall continue in full force and effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Nowah's failure to assert any right under these Terms shall not constitute a waiver of such right.

Assignment: You may not assign or transfer these Terms or your rights hereunder without Nowah's prior written consent. Nowah may assign these Terms without restriction.

No Third-Party Beneficiaries: Except for rights granted to Apple and its subsidiaries under the applicable Apple EULA, these Terms do not confer any rights on any third party.
