- An ETA does not guarantee entry to the UK.
- The holder must obtain permission to enter on arrival and may be refused entry if an ETA is required and they do not have one.
- Tourism is permitted for up to 6 months.
- An ETA cannot be used to stay in the UK longer than 6 months or live there through frequent or successive visits.
- Paid or unpaid work for a UK company or self-employment is not permitted, except for a permitted paid engagement or event or work on the Creative Worker visa concession.
- A national passport is required; a national identity card is not a substitute.
- The ETA lasts 2 years from grant or until passport expiry, whichever is sooner.
- If the application is rejected, the applicant must apply again and the fee is not refundable.
Common refusal reasons
The ETA application must be refused if the Secretary of State has personally directed the applicant’s exclusion, or the applicant is subject to an exclusion order, deportation order, or decision to make a deportation order.
The ETA application must be refused for a UK or overseas conviction carrying a custodial or suspended sentence of 12 months or more, or for any conviction unless more than 12 months have passed since conviction.
The ETA application must be refused where the applicant’s presence in the UK is not conducive to the public good because of conduct, character, associations or other reasons, including convictions outside the criminality grounds.
The ETA application must be refused for specified previous immigration breaches committed when the applicant was aged 18 or older: overstaying, breaching permission conditions, illegal entry, or deception. Overstaying exceptions include later permission granted with knowledge, qualifying voluntary departure with an overstay of 90 days or less beginning before 6 April 2017, qualifying voluntary departure with an overstay of 30 days or less beginning on or after 6 April 2017, and the applicable Exceptions for overstayers provisions. Breach, illegal-entry and deception grounds each preserve the express exception for later permission granted with knowledge.
The ETA application must be refused where, in the current or a previous ETA application, false representations were made, false documents or false information were submitted, or relevant facts were not disclosed.
The ETA application must be refused where the applicant has failed to pay litigation costs awarded to the Home Office.
The ETA application must be refused after an ETA was cancelled by the Home Office under ETA 5.8, unless entry clearance or permission to enter or stay was subsequently granted with knowledge of the cancellation.
The ETA application must be refused after a previous Appendix V: Visitor refusal, unless valid ETA, entry clearance or permission was held and not cancelled as a result, or later valid permission was granted with knowledge of that refusal.
